Because the Box 3 wealth tax may no longer be based on a notional return, it has recently become possible to reclaim overpaid tax retroactively. This is done via the Opgaaf Werkelijk Rendement (OWR) form, introduced as part of the Wet tegenbewijsregeling box 3 (Box 3 counter-evidence scheme). If you held taxable Box 3 assets in recent years, you may already have received a notification letter from the Dutch Tax Authorities (Belastingdienst) at the end of 2024.

Before starting you first have to wait for the letter from the Belastingdienst. A separate letter will be sent for each tax year for which you wish to declare your actual return. Once you receive the letter, you can complete and submit the OWR form. If your calculation shows that the notional return is more favourable, you simply do not submit the form.

A fully redesigned Box 3 system based on actual returns on savings, investments, and real estate is planned for 2028. Until then, the OWR procedure is an important interim step. Please be aware that you are responsible for completing the form yourself – and only after you have received the official letter from the Belastingdienst.
